Joseph Banks was christened on 6 September 1665 at Giggleswick, Yorkshire. He was the son of a gentleman who had been an officer under Sir John Reresby, in the garrison of Bridlington according to Records of the Burgery of Sheffield. He was the son of Robert Banks and Margaret Frankland. Joseph was an apprentice in 1681 at Sheffield. In 1681, at the age of 16 he went to Sheffield, where he was to found his fortune. He was articled to Thomas Chappell, a busy attorney in a large practice: there is a hint that master and pupil may have been related.
His brother Robert held the living of Hooton Roberts, and provided the premium upon the articles of clerkship for his younger brother Joseph in 1681.
Joseph Banks married Mary Hancock on 5 August 1689 at Sheffield, Yorkshire. He married Mary, daughter of Rowland Hancock, of Shirecliffe Hall 5 Aug 1689, and had with her a fortune of £400. "As soon as his articles expired". Joseph was an attorney & MP, Sheffield, Yorkshire. He served articles with Mr Thos. Chappell, attorney, whom he succeeded on the Town Trust [elected burgess 7 Nov 1703]. He acted as agent for the Dukes of Norfolk, Leeds and Newcastle.
Joseph Banks was mentioned in the will of Rev Richard Frankland dated 27 September 1698.
Of Scofton, Ntt. purchased from Sir George Humble the Holland estate for £9900 - this purchase seems to have determined him towards setting himself in Lincolnshire. In 1714 he purchased the Revesby estate (Revesby Abbey, Lincs), which cost £14,000 from the representatives of Craven Howard Esq. being two daughters of Henry Howard; in 1721 he fenced in Revesby Park, in 1726 he purchased the Marsh estate.
In 1715 he was required to furnish the Deputy Lieutenant of the county of Notts. with a 4th part of one horse and horseman at arms for the Militia on account of his estates in the parishes of Worksop and Bligh and also 3 parts more at the expence of the the estates of Thos. Markham Esq. a Papist whose lands were assessed with £6 p.a. to the said Jos. Banks for the premises Jos. then resided at Scrofton, Notts. (Scrofton was an earlier name for Scofton, Joseph had removed there from Sheffield where he had been a thriving solicitor, agent to all the county families of importance)..
Joseph Banks lived at Revesby, Lincolnshire, 1719.
He acted as agent for the Dukes of Norfolk, Leeds and Newcastle. Left Sheffield when scarcely passed middle life, and settled at Scofton near Worksop. Sat in Parliament for Grimsby (Linc) and Totness (Devon). While living at Shirecliffe he cut the gap, which is still called Coach Gate, between the Old Park and Cook Woods, to let his carriage pass by an easier road to Sheffield, than down the Bridgehouse Hill. He was great grandfather of Sir Joseph Banks, K.C.B., president of the Royal Society.
Joseph Banks made a will dated 27 July 1726. Joseph Banks left in his will dated 27 July 1726 £5000 for my niece Steer and her children to be equally divided amongst them ... £3000 for my nephew Joseph Banks and his children ... his niece Wilkinson £1000... she had no issue, Millicent Steer £1000, his cousin Capt John Harris.
